1 Acceptance of Terms

By downloading, installing, or using Posturly (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Fivet Solutions ("we", "our", or "us").

2 Description of Service

Posturly is a posture improvement application that provides:

• On-device posture analysis using your device's camera and Apple's Vision framework
• Personalized exercise recommendations for posture improvement
• Progress tracking including posture scores, streaks, and achievements
• Smart reminders for posture checks and exercises
• Export and sharing functionality for your posture data

4 Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have your parent or guardian's consent to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

5 User Data & Account

• Posturly does not require account creation. All your data is stored locally on your device.
• You are responsible for maintaining the security of your device and backing up your data.
• If you delete the App or reset your data, it cannot be recovered.

6 Data Processing & Privacy

• All posture analysis is performed entirely on your device using Apple's built-in Vision framework. No images or body pose data are sent to any external server.
• Posturly does not use any third-party AI services, cloud-based machine learning, or external data processing services.
• The App does not collect, transmit, or share your personal data with any third parties.

7 Subscriptions & Payments

a) Free Tier

• The App offers a free tier with limited features including basic posture analysis, 10 exercises, and up to 3 daily reminders.

b) Posturly Pro Subscription

• Premium features require an active Posturly Pro subscription.
• Subscription plans include Monthly ($2.99/month), Quarterly ($7.99/quarter), Semi-Annual ($14.99/6 months), and Yearly ($24.99/year).
• All subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions.
• Subscriptions auto-renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Payment is charged to your Apple ID account at confirmation of purchase.
• You can manage or cancel your subscription at any time through Settings > [Your Name] > Subscriptions on your device.

c) Free Trial

• New users may be eligible for a 3-day free trial of Posturly Pro.
• The trial automatically converts to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends.
• Only one free trial is available per Apple ID.
• Any unused portion of a free trial will be forfeited upon purchasing a subscription.

d) Refunds

• All refund requests must be directed to Apple through the App Store, as we do not process payments directly.

8 User Responsibilities

When using Posturly, you agree to:

• Use the App responsibly and in accordance with these Terms
• Not perform exercises that cause pain, discomfort, or are beyond your physical capabilities
• Ensure adequate space and a safe environment when performing exercises
• Not attempt to reverse engineer, decompile, or modify the App
• Not use the App for any unlawful purpose or in violation of any applicable laws
• Not share or redistribute the App or its content without authorization

9 Intellectual Property

All content, features, functionality, design, text, graphics, logos, icons, and software within Posturly are owned by Fivet Solutions and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the App without our explicit written permission.

10 Limitation of Liability

To the maximum extent permitted by applicable law:

• Posturly and Fivet Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• We are not liable for any physical injury, health issues, or medical complications that may result from following the App's exercise recommendations or posture advice.
• The App is provided "as is" and "as available" without warranties of any kind, either express or implied.
• We do not guarantee the accuracy, completeness, or reliability of posture analysis results.
• Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11 Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's reliability, availability, accuracy, or fitness for a particular purpose. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

12 Termination

• We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.
• You may terminate your use of the App at any time by deleting it from your device.
• Upon termination, all licenses and rights granted to you under these Terms will immediately cease.

13 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the use of the App shall be resolved through appropriate legal channels.

14 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the "Last updated" date at the top of these Terms. Your continued use of the App after any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

15 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
